1. Quotations and Orders
These Terms and Conditions apply to quotations, orders and the supply of kitchen and bedroom products and related services by MD Kitchens and Bedrooms Limited (“MD Kitchens”, “we”, “us” or “our”).
The products and services supplied will be those specified in the relevant quotation, invoice, drawings, specification or other written agreement.
A quotation is based on the information available at the time of preparation and is subject to confirmation. Any quotation validity period will be stated on the quotation where applicable.
An order will be accepted in accordance with the agreed quotation and any subsequent written confirmation. The agreed documents should be read together to establish the products, services and scope of work included.
Any products, services, accessories or installation work not expressly included in the agreed quotation or written specification are excluded.
2. Design, Measurements and Specification
The customer is responsible for carefully checking and approving the proposed design, drawings, dimensions, layout, styles, colours, finishes, handles, worktops, appliances, sinks, taps, lighting, storage and other specified items before manufacture or ordering.
Any approval given by the customer confirms acceptance of the relevant design and specification for the purposes of proceeding with the order.
Where changes are requested after the initial approval but before manufacture or ordering has commenced, we will consider whether the changes can be accommodated. Changes may affect the price, delivery schedule or installation arrangements.
Any agreed changes to the price, specification or scope of work will be confirmed in writing before implementation.
Once manufacture or ordering has commenced, changes may not be possible and may result in additional costs, delays or charges arising from commitments already made to manufacturers or suppliers.
The final agreed design and specification will be confirmed in writing where applicable.
3. Prices and Payment Terms
Prices will be set out in the relevant quotation, invoice or written agreement and will include VAT where stated.
Where a deposit is required, the amount and payment arrangements will be communicated to the customer before the order proceeds.
Unless expressly agreed otherwise in writing, any deposit paid will be deducted from the final amount payable.
Where the final design or specification changes, the total price may increase or decrease accordingly. Any revised total and outstanding balance will be confirmed in writing.
Unless otherwise agreed in writing, any outstanding balance for supplied products must be received in cleared funds no later than one calendar day before the scheduled delivery.
We reserve the right to postpone delivery where payment due before delivery has not been received. Any postponement will be handled in accordance with the contract and applicable law.
Any additional products, services or work requested outside the agreed scope may incur additional charges. Such charges will be agreed with the customer before the additional work is undertaken, except where otherwise lawfully permitted.
4. Delivery and Lead Times
Delivery dates and lead times are estimates unless expressly confirmed as binding in writing.
Delivery may be affected by manufacturer or supplier availability, production schedules, transport arrangements and circumstances outside our reasonable control.
If a material delay occurs, we will inform the customer and communicate any revised delivery arrangements as soon as reasonably practicable.
The customer must provide suitable access for delivery and ensure that the delivery address and any relevant access restrictions have been accurately communicated in advance.
Additional costs arising from failed delivery, restricted access or circumstances attributable to the customer may be charged where reasonable, lawful and agreed or otherwise permitted under the contract.
Nothing in this section removes any statutory rights the customer may have concerning delivery.
5. Customer Responsibilities
The customer must provide accurate information regarding the property, measurements where supplied by the customer, access restrictions and any circumstances that may affect delivery or installation.
Where applicable, the customer is responsible for ensuring that the installation area is reasonably prepared and accessible, that necessary utilities are available, and that existing furniture, fittings or appliances are removed where agreed to be the customer's responsibility.
The customer must obtain any permissions or approvals required for the proposed work and must keep children, pets and other occupants away from active work areas.
Any structural, electrical, plumbing, gas, building or other specialist work must be carried out by appropriately qualified persons where required by law.
Delays, additional work or costs caused by inaccurate information, unsuitable property conditions or failure to prepare the premises may result in revised arrangements and additional charges where agreed and legally recoverable.
6. Installation and Independent Fitters
Where installation is included or arranged, the quotation or written agreement will identify the applicable installation arrangements and scope of work.
Where fitting is undertaken by a self-employed or independent fitter who contracts directly with the customer, the fitting arrangement is separate from the supply of products by MD Kitchens and Bedrooms Limited.
In such cases, the fitter is responsible for their own fitting agreement, charges, invoices or receipts, and applicable tax and VAT obligations.
Any additional fitting work outside the agreed scope must be agreed with the person responsible for carrying out the fitting and may incur additional charges.
The customer should raise workmanship concerns promptly with the fitter. Where appropriate, MD Kitchens may assist in liaising with the fitter to help establish the cause of a reported issue and identify a suitable resolution.
Any specific workmanship warranty will be set out in the applicable fitting agreement or separate written confirmation.
Nothing in these terms excludes or limits any responsibility that MD Kitchens or an independent fitter may have under applicable law.
7. Colours, Materials and Finishes
Colours and finishes shown on screens, websites, brochures, photographs or printed materials may differ from the finished product.
Samples are intended to be representative, and reasonable variations may occur due to manufacturing processes, production batches, lighting and the characteristics of the materials used.
Natural materials, including wood and stone, may vary in colour, grain, veining, texture and pattern.
Different products or materials may also have reasonable differences in shade, texture or finish.
The customer should approve the selected colours, materials and finishes before manufacture or ordering.
Reasonable variations consistent with the agreed specification and applicable law will not necessarily constitute a defect. This does not affect the customer's statutory rights where products fail to conform to the contract.
8. Bespoke and Made-to-Measure Products
Some products are manufactured, ordered or customised specifically to the customer's requirements.
Cancellation rights for bespoke, personalised or made-to-measure products may differ from those applicable to standard products. In certain circumstances, statutory cancellation rights may not apply once manufacture or ordering has commenced.
The customer's rights will depend on the nature of the contract, how and where it was entered into, the products or services involved, and the applicable consumer legislation.
Nothing in these terms removes any cancellation, refund or other statutory right that cannot lawfully be excluded.
Customers should contact MD Kitchens as soon as possible if they wish to request a cancellation or change to an order.
9. Defects, Damage and Complaints
The customer should inspect delivered products as soon as reasonably practicable and notify MD Kitchens of any visible damage, missing items, incomplete deliveries or suspected defects.
Where a product appears defective, damaged or inconsistent with the agreed specification, the customer should provide a description of the issue and, where reasonably possible, supporting photographs.
We will investigate reported product issues and, where appropriate, arrange a remedy in accordance with the contract, any applicable manufacturer warranty and statutory consumer rights.
Where the issue relates to installation workmanship, it should also be reported promptly to the person responsible for the fitting.
Where a complaint may involve both products and installation, MD Kitchens and the relevant fitter may liaise with the customer to establish the cause and appropriate next steps.
Customers should take reasonable steps to prevent further damage while an issue is being investigated. They should not arrange unnecessary repairs or alterations that may affect the assessment of the problem, except where reasonably necessary to prevent immediate damage or address a safety concern.

10. Warranties and Statutory Rights
Manufacturer warranties apply in accordance with the relevant manufacturer's terms and conditions. Any additional warranty offered by MD Kitchens or an independent fitter will be confirmed separately in writing and will be subject to its stated terms.
Manufacturer warranties and any additional warranties do not replace or reduce the customer's statutory rights.
Nothing in these Terms and Conditions excludes, restricts or limits any consumer right, legal responsibility or remedy that cannot lawfully be excluded, restricted or limited.
11. Cancellations and Amendments
Requests to cancel or amend an order must be communicated to MD Kitchens in writing. The options available following a cancellation request will depend on the type of products or services ordered, the stage of manufacture or ordering, the terms of the contract and any applicable statutory cancellation rights.
Where products have been specially manufactured or ordered, reasonable costs already incurred may be relevant to determining the consequences of cancellation, subject to the contract and applicable law.
Any cancellation charges must have a lawful basis and must not exceed what is contractually and legally recoverable.
Where a statutory cancellation right applies, it will be honoured in accordance with the applicable legislation.
12. Circumstances Beyond Our Reasonable Control
We will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including significant supplier disruption, transport interruptions, industrial action, severe weather or other unforeseen events.
Where such circumstances affect an order, we will communicate the impact and take reasonable steps to minimise disruption.
This provision does not remove any statutory consumer rights or other obligations that continue to apply in the circumstances.
13. General Provisions
These Terms and Conditions should be read alongside the relevant quotation, invoice, drawings, specification and any other written agreement relating to the order.
Where a specific written agreement expressly varies these general terms, the specific agreement will take precedence to the extent of the agreed variation.
If any provision of these terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Nothing in these terms creates an employment relationship between MD Kitchens and an independent fitter.
14. Governing Law
These Terms and Conditions are governed by the laws of England and Wales, subject to any mandatory consumer protections applicable to the customer.
Nothing in these terms limits the customer's right to rely on any mandatory legal protections or to bring a claim before a court with appropriate jurisdiction.
15. Acceptance of Terms
By placing an order, accepting a quotation or making a payment towards an order, the customer agrees to these Terms and Conditions where they have been made available to the customer before or at the time the contract is formed and have been properly incorporated into the agreement.
The applicable quotation, specification and any subsequent written amendments form part of the agreement between the parties.
